NEWMARK WINS ACQUITTAL ON ALL CHARGES IN FATAL CRASH

Yesterday, a Benton County jury acquitted Eric Newmark’s client on all charges stemming from a motor vehicle accident involving a fatality.  Newmark’s client, a commercial truck driver, was accused of causing the accident by being careless and inattentive.  The prosecution’s evidence included a driver-facing camera which three State Troopers, including an accident reconstructionist and a vehicle inspector,  claimed showed Newmark’s client with his eyes closed for seven seconds prior to the fatal crash.  The jury viewed the video at trial and was persuaded by Newmark’s arguments to the contrary.  If convicted, Newmark’s client faced incarceration and a loss of his commercial license.
